Terms of use
- At the start of your ride, carry out brake tests at a low speed to check the response.
- Wearing a helmet is compulsory (included in the hire price)!
- You must comply with the provisions of the Road Traffic Regulations (StVO); the route follows farm tracks with car and lorry traffic. (CAUTION: oncoming traffic)
- Use is at your own risk; driving style and speed must be adapted to your own ability and the terrain.
- Children under 10 years of age and shorter than 140 cm may only ride on the same Mountaincart accompanied by an adult. Children aged 10 and over and taller than 140 cm may ride a Mountaincart on their own, but only when accompanied by an adult or legal guardian. Young people aged 16 and over may ride unaccompanied.
- You must only use the marked forest track.
- A ride on the mountain cart must be completed without stopping, without exception. Should it become necessary to stop, you must do so at the right-hand side of the track.
- Keep a safe distance from the edge of the track.
- IMPORTANT: Be considerate of walkers
- Photo stop: Photos will be taken during the ride.
Terms and conditions
Gargellner Bergbahnen offers a booking tool for the use of Mountaincarts on shop.bergbahnen-gargellen.at.
1. Terms and Conditions of Sale and Delivery
a) The contract is concluded with Gargellner Bergbahnen GmbH & Co KG (FN 16031a).
b) Only persons aged 18 or over are entitled to book Mountaincarts.
c) If a booking is made on behalf of third parties, the person making the booking is obliged to make these third parties aware of the terms of use and the general terms and conditions, and to ensure that these third parties comply with the terms of use and the general terms and conditions.
d) The booking of a Mountaincart includes 20% VAT.
2. Procedure
a) Bookings made on shop.bergbahnen-gargellen.at/de must be paid for using Visa, Mastercard or PayPal.
b) The booking only becomes valid once the full amount has been paid.
c) The customer must collect their tickets at the Schafbergbahn mountain station.
d) Once the booked service has been collected, the currently valid General Terms and Conditions (contract terms) of Gargellner Bergbahnen GmbH & Co KG for tickets and ski passes shall apply.
e) Only persons aged 18 or over are entitled to book Mountaincarts.
f) Individual technical steps: You can select a Mountaincart booking with a click of the mouse. The relevant date is now shown in the order form. You can select the time in the field below. Further down the page, the Mountaincart sizes are displayed, from which you can choose the one that suits your height. Here, you can select the time, size and quantity with a click of the mouse and add them to your basket using the ‘Add to basket’ button. You will then be shown an overview of the booked Mountaincarts (date, time, size and quantity) as well as the price. By clicking the ‘Buy now’ button, you must enter your personal, contact and address details; clicking the ‘Continue to personalisation’ button personalises the Mountaincarts for the respective users (entering first name, surname and date of birth). Once the user details have been successfully entered, they are saved by clicking the ‘Save’ button. Clicking ‘Next’ takes you to the next step, where you’ll see an overview of your personal details and the services booked (including size). By clicking on the ‘General Terms and Conditions’, you accept them; clicking the ‘Place order with payment’ button takes you to the final step, where you select your payment method. Here, you can choose between credit card and PayPal. The contract is only concluded once you click the ‘Pay’ button. Until then, the ordering process can be cancelled at any time. The ticket will be sent to the customer by email.
g) Input errors: Any errors made during the booking process can be corrected at any time by clicking the ‘Back’ or ‘Change address’ buttons.
3. Refunds (Cancellation) and Validity
There is no right of refund for booked Mountaincart rides. Tickets are valid only for the booked departure. Users must arrive at the Schafbergbahn mountain station approximately 10 minutes before departure.
4. Liability
The customer uses this website at their own risk. Gargellner Bergbahnen GmbH & Co KG accepts no liability for any damage arising from the use of this website. Gargellner Bergbahnen GmbH & Co KG also accepts no liability for interruptions, technical faults, maintenance work, etc. The marketing association will rectify any malfunctions or outages as quickly as possible.
Each hirer, waiving any right of recourse or claim for liability against Gargellner Bergbahnen GmbH & Co KG and its employees, assumes full liability for all personal injury and property damage caused to themselves and/or other persons through the use of the hired sports equipment.
Damage
In the event of damage to the Mountaincarts caused by the hirer, Gargellner Bergbahnen GmbH & Co KG reserves the right to charge for the costs incurred for repairs.
Use
The tenant is obliged to comply with the terms and conditions of use displayed on site and to follow the signposted route.
5. Data Protection
Gargellner Bergbahnen GmbH & Co KG declares that it complies with the Austrian Data Protection Act (DSG 2000). Furthermore, the marketing association undertakes to keep the data provided by the customer confidential, unless there is a legally permissible reason for the transfer or disclosure of the data entrusted to it or to which it has gained access. Data such as credit card numbers, sort codes, account numbers, names and addresses provided when paying by credit card are transmitted via a secure SSL connection. The customer’s details are processed using automated systems. The customer will only receive promotional information from Gargellner Bergbahnen GmbH & Co KG with their separate consent.
6. Copyright provisions
All text, graphics, design and logos on the Marketing Association’s website are intended solely for the customer’s personal information. Use is at the customer’s own risk. All data on this website is protected under the provisions of the Copyright Act. The reproduction, copying and printing of the voucher are permitted solely for the purpose of redeeming it. Any use beyond this exceeds fair use and constitutes a breach of copyright.
7. Jurisdiction
It is agreed that Austrian law shall apply to all disputes arising from this agreement and that the Austrian court with local and subject-matter jurisdiction over the registered office of Gargellner Bergbahnen GmbH & Co KG shall have exclusive jurisdiction. The place of jurisdiction is Bregenz.
8. Miscellaneous Provisions
Any deviating, conflicting or supplementary general terms and conditions shall not form part of this contract.
Should any individual provisions of these General Terms and Conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. All declarations relating to this contractual relationship must be made in writing. Should individual provisions of these General Terms and Conditions be legally invalid, the remaining provisions shall remain in force. Notifications and declarations of intent shall be deemed legally valid when sent to the address provided by the customer in the order, unless another address is notified in writing. The customer is obliged, upon conclusion of the contract, to provide the relevant data requested in the contract completely and correctly, and to notify the supplier immediately in writing of any changes to their name, address or place of residence. In the event of failure to comply, any written notification sent to the customer’s last known address shall be deemed sufficient to meet the requirements for valid service. Should the customer provide incorrect, incomplete or unclear details, they shall be liable for all costs and damages incurred by Gargellner Bergbahnen GmbH & Co KG as a result.
